Terms of Use of the MAPEN Platform

§1. General Provisions
These Terms of Use (hereinafter: “Terms”) set forth the rules for using the MAPEN Platform, which consists of:
a) a mobile application intended for Participants,
b) a web panel intended for Organizers.The MAPEN Platform is a collective term encompassing the mobile application and the web panel.
The administrator of the MAPEN Platform is MAPEN Spółka z ograniczoną odpowiedzialnością, ul. Strumykowa 19A/29, Warsaw 03-138, Tax ID: 5243034036, KRS: 0001162377 (hereinafter: “Administrator”).
Use of any part of the MAPEN Platform constitutes acceptance of these Terms. Failure to accept any of the provisions prevents further use of the mobile application or web panel.
Registration of an Organizer in the web panel constitutes a declaration by the registering person that they have the authority to act on behalf of the represented entity. The Administrator may at any time request presentation of a document confirming such authority.
The Administrator reserves the right to update the Terms. Users will be informed about planned changes to the Terms at least 14 days in advance by making the new text of the Terms available in the mobile application and web panel and sending information to the email address associated with the account. If a User does not accept the changes, they may terminate the agreement by deleting their account before the effective date of the changes. Continued use of the Platform after the effective date of changes constitutes acceptance of the amended Terms.
To use the MAPEN Platform, the following are required:
a) a device with Internet access,
b) iOS or Android operating system in current or supported version (for the mobile application),
c) current web browser (for the web panel),
d) active email account,
e) active mobile phone number.The MAPEN Platform enables Participants to browse Events, create Packs, and communicate with other Participants through the mobile application, and enables Organizers to add and manage Events through the web panel. The Platform cooperates with commonly used operating systems and external services, particularly in the area of login, in accordance with the principles established by their providers.
§2. Definitions
MAPEN Platform – collective term encompassing the mobile application and web panel made available by the Administrator.
Mobile Application – an application intended for mobile devices, enabling Participants to browse events, join them, and create packs.
Web Panel (Organizer Panel) – part of the MAPEN Platform accessible through a web browser, intended for Organizers.
Administrator – MAPEN Spółka z ograniczoną odpowiedzialnością, the entity responsible for managing and operating the MAPEN Platform.
Participant – a natural person with an account in the mobile application who browses events, joins them, or creates packs.
Organizer – an entity conducting business activity or an organization with an account in the web panel, adding and managing events.
User – a Participant or Organizer using the MAPEN Platform.
Event – an activity organized by an Organizer, made available to Participants through the MAPEN Platform.
Pack – a group of Participants created in the mobile application for the purpose of joint participation in events.
User Account – an individual profile enabling use of functions available in the mobile application (for Participants) or in the web panel (for Organizers).
§3. Participant and Organizer Account
Age Requirements
1.1. Use of the mobile application is permitted only for persons who have reached 18 years of age. Account registration constitutes a declaration that this condition has been met. The Administrator does not direct the Platform to persons under 18 years of age and does not knowingly process personal data of such persons. If the Administrator becomes aware that an account has been created by a person under 18 years of age, the Administrator reserves the right to immediately delete such account. In case of account deletion due to false declaration of age, the Administrator is not liable for loss of data or content.Modification, Suspension, and Deletion of Account
2.1. The Administrator may, in justified cases, modify, suspend, or delete a User’s account, as well as restrict access to selected functions of the MAPEN Platform, particularly in case of:
a) violation of the provisions of the Terms or law,
b) suspicion of actions violating the security of the Platform, other Users or third parties, principles of social coexistence, or good morals,
c) suspicion of impersonating other persons, providing false data, or falsifying data,
d) using the Platform in a manner that may disrupt its operation or threaten security (e.g., attempts at unauthorized access, automation/bots).
The Administrator takes actions in a manner proportional to the nature and severity of the violation; whenever possible, such actions are preceded by a warning or request to remedy the violations, unless immediate action is necessary due to Platform security, other users, or legal requirements.
2.2. Information about the decision taken, along with its justification, will be communicated to the User at the email address associated with the account, unless providing such information is impossible or unjustified due to applicable law, Platform security, or prevention of abuse.
2.3. The User has the right to appeal the Administrator’s decision within 14 days from the date of receiving the information referred to in section 2.2, via email. The Administrator will review the appeal within a reasonable time.
2.4. In cases where continued use of the Platform by the User could cause damage, violation of law, threat to the security of the Platform, other Users, or third parties, the Administrator may apply restrictive measures or block the Account with immediate effect, without prior warning. The Administrator is not liable for the consequences of such actions, provided they were justified and taken in accordance with applicable law.
2.5. The User may delete their User Account at any time through a function available in the mobile application or web panel.
2.6. Upon submission of a request to delete the User Account, the account is deactivated and the User loses access to the MAPEN Platform in the scope assigned to that account.
2.7. For a period of 30 days from the moment of User Account deactivation, the User has the option to restore the account by logging in to the MAPEN Platform again. In such case, the account deletion request is canceled.
2.8. After expiration of the period referred to in section 2.7, the User Account is permanently deleted and cannot be restored.
2.9. During the period referred to in section 2.7:
a) in the case of a Participant, login credentials, including username, email address, and phone number, remain reserved and cannot be used by other users,
b) in the case of an Organizer, the email address associated with the account remains reserved.
2.10. After permanent deletion of the User Account:
a) in the case of a Participant, the username, email address, and phone number may be reused to create a new account,
b) in the case of an Organizer, the email address may be reused to create a new account, unless the Administrator decides otherwise.
2.11. The Administrator reserves the right to prevent re-registration in case of account deletion due to violation of the Terms or imposition of a permanent account block on the User.Registration and Account Data
3.1. To create an account in the mobile application, the Participant is required to:
a) provide age, email address, phone number, and password,
b) accept the Terms and Privacy Policy.
It is also possible to log in using an external account (Facebook, Google), however, regardless of the chosen login method, providing age and phone number is required.
3.2. To create an account in the Organizer Panel, the Organizer is required to provide the following mandatory data: email address, password, Organizer name, and description of conducted activity (e.g., scope of activity or type of organized events). The Organizer may voluntarily provide additional data, particularly Tax ID number, registered office address (street, postal code, city), and links confirming conducted activity (e.g., website or social media profile). If the Tax ID number is not provided, the description of conducted activity must enable its verification by the Administrator.
3.3. Data entered by the Organizer may be modified, however, each change requires approval by the Administrator. Information about acceptance or rejection of changes will be sent to the email address provided during account creation (not to the address in the “Contact” field).
3.4. The User is obligated to keep login credentials to the User Account confidential and not share them with third parties. The Administrator is not liable for consequences of sharing login credentials by the User.
§4. Fees and Payments
Mobile Application
Use of the mobile application of the MAPEN Platform by Participants is free.Organizer Panel
2.1. Adding events by Organizers through the web panel and access to basic statistics regarding events and Participant activity within these events are currently free.
2.2. The Administrator may in the future introduce paid features available in the Organizer Panel, including particularly event promotion features or extended statistical features.
2.3. Detailed information regarding the scope of paid features, conditions of their provision, prices, and payment methods will be indicated in the Organizer Panel before using a given feature.
2.4. All changes regarding paid status of individual features will be communicated to Organizers in advance, via the web panel or email.Fees Set by Organizers
3.1. Organizers may set fees for participation in events (e.g., admission or participation in specific activities). The MAPEN Platform does not conduct ticket sales nor collect commissions on such payments.
3.2. Prices for participation in events are set solely by Organizers and are presented in the mobile application for informational purposes. The Administrator is not liable for any discrepancies between presented information and actual participation conditions.
3.3. Settlements between a Participant and an Organizer may be realized outside the Platform or using external payment systems, according to information provided by the Organizer. The Administrator is not a party to these transactions.Payments to the Administrator
4.1. In case of introduction of paid features, payments to the Administrator are made in advance, according to the price list indicated in the Organizer Panel.
4.2. Prices are given in Polish zloty (PLN) and include applicable taxes, unless otherwise indicated.
4.3. Payments are made using external payment operators.
4.4. If the Organizer consents to commencement of provision of a paid service before expiration of the withdrawal period, they acknowledge that upon commencement of service provision they lose the right of withdrawal, in accordance with applicable law.Payment Security and Authorization
5.1. Each Organizer declares that they are authorized to use the payment method selected during purchase of paid features.
5.2. The Administrator and payment operators have the right to reject payment if the payment method is incorrect, invalid, or rejected by the financial institution.
5.3. The Administrator and payment operators may make payment corrections or refunds in case of errors or other justified situations, in accordance with applicable law and internal policies.
§5. Content and Privacy
Information Published on the Platform
1.1. Within the MAPEN Platform, content may be published both by persons using the mobile application and by event organizers in the web panel.
1.2. Organizers may share, among others:
a) event title and description,
b) date, time, and location,
c) participation prices,
d) graphics promoting the event.
1.3. Persons creating a profile in the mobile application may provide basic information about themselves, such as age, name, profile photo, and other data visible to other participants – according to application settings.Responsibility for Content
2.1. Each person publishing content on the MAPEN Platform bears full responsibility for its compliance with law and these Terms. When adding content, one must ensure that:
a) they have the rights to publish it (including copyrights, image rights, consents to use materials),
b) the content does not contain personal data of third parties without their explicit consent,
c) the content does not violate law, good morals, or third-party rights.
2.2. The Administrator reserves the right to remove content that violates the Terms, applicable regulations, or may negatively affect the security and comfort of using the Platform.
2.3. Some public elements (e.g., event name, location) may be visible to internet search engines. Content in private areas (e.g., packs, messages) is not publicly accessible.
2.4. Content published within private communication between Participants is not publicly accessible.
2.5. The Administrator does not analyze or monitor private content continuously. Private content is processed only to the extent technically necessary for proper functioning of the Platform and for handling reports of Terms violations, in accordance with principles specified in the Privacy Policy.License to Use Content
3.1. Content published on the Platform does not become the property of the Administrator. However, to enable proper functioning of the MAPEN Platform (including promoting events, presenting information in the application, adapting content to various devices), the person publishing content grants the Administrator a free, non-exclusive, and perpetual license to:
a) store,
b) display,
c) modify (in terms of graphic layout),
d) publicly share within the Platform,
e) present in promotional materials related to the Platform.
3.2. The User declares that they possess all rights to published content, including copyrights, and that such content does not violate third-party rights.
3.3. In case published content contains the image or personal data of third parties, the User declares that they have appropriate consents for their publication and for granting the Administrator a license to the extent specified in these Terms.
3.4. The license remains valid also after cessation of using the MAPEN Platform only to the extent necessary for proper operation of services, archiving, and maintaining data consistency (e.g., Event history).
3.5. The license does not cover content published within private communication between Participants, particularly private messages and content shared exclusively within Packs.
3.6. The license also includes use of Content for informational and marketing purposes related to MAPEN Platform activities, particularly on the Administrator’s website, in the mobile application, in the web panel, and in the Administrator’s official communication channels and social media.
3.7. The license does not include the right to grant sublicenses, except for technical services (e.g., hosting).Data Protection and Privacy
Data provided during use of the MAPEN Platform is processed in accordance with applicable regulations and principles described in the Privacy Policy available on the website and in the application. The Administrator is not responsible for the manner of data use by other persons using the Platform (e.g., in private messages or groups). Caution is recommended when sharing personal and contact data.
§6. Rules for Using the Platform
Compliance with Law and Regulations
When using the MAPEN Platform, each User is obligated to:
a) comply with the provisions of these Terms and Privacy Policy,
b) comply with applicable law,
c) respect the rights of others, including copyrights, personal rights, and privacy.Content Posted by Others
The Administrator does not continuously check all content added by Users. If inappropriate, illegal, or rule-violating content is reported, the Administrator may remove it and take other actions, such as account suspension.Interactions Between Users
The Administrator is not a party to arrangements or relationships between Users – including those that take place outside the Platform (e.g., at an event). The Administrator also does not verify identity nor is liable for the truthfulness of information provided by Users. Caution and common sense are recommended when contacting other Users – both online and offline.Prohibited Actions
On the MAPEN Platform, the following are prohibited:
a) sharing content that is unlawful, misleading, offensive, or violates others’ rights,
b) attempting to gain unauthorized access to the system,
c) taking actions that may disrupt Platform operation,
d) using the Platform to conduct activities inconsistent with its purpose (e.g., mass data collection, promoting own services unrelated to events),
e) copying, decompiling, selling, or modifying Platform software without Administrator consent,
f) using the Platform to collect personal data of other persons.Platform Modifications
The Administrator may introduce changes to Platform functionalities, including adding new features, modifying or removing existing ones. Changes of a technical, organizational, or developmental nature that do not significantly affect the manner of using the Platform may be introduced without prior notice. Changes affecting paid features or features important to Users will be communicated in advance, in a manner appropriate to the nature of the change.External Sites and Services
6.1. The MAPEN Platform may contain links to external websites or services. The Administrator is not liable for their availability, content, manner of operation, or compliance with law. Any interruptions, errors, or unavailability of external services do not constitute improper performance of services by the Administrator. Use of such services is at the User’s own risk.
6.2. The Platform may use analytical tools to improve service quality, in accordance with principles described in the Privacy Policy.
§7. Disclaimer of Liability
Scope of Administrator’s Liability
To the maximum extent permitted by applicable law, the User acknowledges and accepts that the Administrator is not liable for:
a) actions, omissions, or errors of Organizers, including those concerning content posted by them on the Platform,
b) interactions and relationships between Participants – both online and during events,
c) transactions made outside the Platform, particularly regarding participation in events or purchase of services offered by third parties.Waiver of Claims
The User will not direct claims against the Administrator to the extent that the Administrator’s liability has been effectively excluded under these Terms and applicable law.No Liability of Administrator for Organizer Actions
The Administrator is not liable for actions or omissions of Organizers related to organization and realization of Events, including Participants’ claims against Organizers. The Administrator is not a party to contracts or arrangements between Participants and Organizers and does not guarantee the truthfulness, reliability, or completeness of information published by Organizers.Risk of Participation in Events
The Participant acknowledges that participation in events may involve certain risks – including threats to health or life – and participates in them at their own risk.
§8. Obligation to Cover Damages
User’s Liability for Violations
To the maximum extent permitted by applicable law, the User undertakes to release the Administrator from liability and cover all damages, claims, costs, losses, and expenses (including reasonable legal service costs) that arise from or are related to:
a) User’s violation of these Terms,
b) improper or inconsistent with intended purpose use of the Platform,
c) content added by the User,
d) User’s violation of applicable law, third-party rights, or good morals,
e) User’s actions during participation in events published on the Platform that are contrary to the Terms or law.Obligation to Cooperate and Inform
The User undertakes to immediately inform the Administrator of any third-party claim made against them, cooperate in clarifying the matter, and cover all reasonable costs related to its legal handling if the Administrator becomes a party to a dispute or court proceeding as a result of User’s actions or omissions.Prohibition on Making Settlements Without Administrator Consent
The User undertakes not to make any settlements with third parties without prior written consent of the Administrator if the matter concerns claims related to use of the Platform.
§9. Disclaimer of Warranties and Limitation of Liability
Nature of the Platform
The MAPEN Platform is made available on an “as is” and “as available” basis, without any warranties – express or implied – regarding its operation, reliability, availability, fitness for a particular purpose, or conformity with User expectations.Scope of Warranty Disclaimer
To the maximum extent permitted by law, the Administrator does not provide any warranties regarding:
a) reliability, timeliness, accuracy, or effectiveness of the Platform,
b) information, advice, services, or products available through the Platform,
c) results that may be achieved through use of the Platform,
d) uninterrupted or error-free operation of the Platform,
e) materials or data obtained by the User as a result of using the Platform,
f) any actions or content of third parties (including marketing partners, Organizers, or other Users).Exclusion of Liability for Damages
The Administrator is not liable for any damages – direct, indirect, incidental, special, or consequential – including but not limited to:
a) lost profits,
b) data loss,
c) reputation damage,
d) moral losses,
e) business interruptions,
regardless of the cause of their occurrence, even if informed of the possibility of their occurrence.Limitation of Financial Liability
The total liability of the Administrator to the User or a third party, regardless of legal basis (including contractual and tort liability), arising from use of the MAPEN Platform is limited to the total amount of fees actually paid by the given User for paid Platform features in the 12-month period preceding the event constituting the basis for liability. In the absence of such fees, the Administrator’s liability is excluded, unless contrary to mandatory provisions of law.Exceptions to Limitations
The above limitations do not apply in case of:
a) gross negligence, willful misconduct, or fraud on the part of the Administrator,
b) liability whose exclusion is impossible under applicable law.Rights of EU Users
Users from the European Union have statutory means of protection in case of suffering damage as a result of violation of legal obligations by the Administrator – this paragraph does not limit these rights.
§10. Dispute Resolution
Amicable Dispute Resolution
In case of any claims, disputes, or objections regarding use of the MAPEN Platform or performance of these Terms, the User should first contact the Administrator to enable amicable clarification of the matter and limitation of potential damages, particularly via the email address indicated in §12 section 2.Disputes Between Participants and Organizers
The Administrator is not a party to relationships between Participants and event Organizers. The Administrator also does not resolve disputes between them, unless required by law or justified in connection with violation of these Terms. In such cases, the Administrator may decide to block an account or remove content.Court Proceedings
All disputes between the User and the Administrator will be resolved by a court with jurisdiction according to general principles.Users from the European Union
Users residing in the European Union have statutory means of protection resulting from local consumer law – these Terms do not limit them. Additionally, they may use the online dispute resolution platform (ODR), available at: https://ec.europa.eu/consumers/odr
§11. Intellectual Property
Administrator’s Intellectual Property Rights
All rights to elements constituting the MAPEN Platform, including its name, logo, graphic layout, text content, promotional materials, source code, and databases, belong to the Administrator or cooperating entities based on appropriate licenses. Copying, distributing, modifying, using, or reproducing any content protected by copyright or constituting trademarks without prior express consent of the Administrator is prohibited, unless otherwise provided by law.Intellectual Property Rights of Other Entities
Users are obligated to respect the intellectual property rights of third parties. Publishing content on the Platform that violates copyrights, trademark rights, image rights, or other rights of third parties is inadmissible.Violation Reports
3.1. In case of justified suspicion that any content available on the Platform violates copyrights or other intellectual property rights, the Administrator should be contacted immediately to report such violation. The report should contain:
a) contact information of the reporting person,
b) precise description of content subject to violation,
c) legal basis or justification for the violation,
d) request to remove or block access to indicated content.
3.2. The Administrator reserves the right to take appropriate actions, including removing disputed content or restricting Platform access to persons repeatedly violating intellectual property rights.
§12. Final Provisions
Translation
These Terms have been prepared in Polish. In case of discrepancies between different language versions, the Polish version is binding.Contact and Notifications
All correspondence related to the Terms should be directed to the email address: contact@mapenapp.com or by mail to the Administrator’s address indicated in the contact section of the Platform. Information directed to the User will be sent to the email address associated with their account.Entire Agreement
The Terms together with the Privacy Policy and any additional regulations (e.g., payment rules, content policy, API usage rules) constitute the entire agreement between the User and the Administrator and replace all previous arrangements in this regard.No Representative Relationship
No provision of the Terms creates a representative relationship, partnership, employment relationship, cooperation, or other legal relationship between the User and the Administrator. Neither the Participant nor the Organizer has the right to represent the Administrator or undertake any obligations on its behalf. The Administrator is not liable for Organizers’ actions, including the course of events, communication with participants, or fulfillment of any financial obligations.Applicable Law
The Terms are governed by Polish law, taking into account mandatory provisions of law applicable to the consumer.Competent Courts
All disputes between the User and the Administrator will be resolved by a competent court according to general provisions of law. Users residing in the European Union may also use the ODR (Online Dispute Resolution) platform made available by the European Commission.Transfer of Rights
The User may not transfer their rights or obligations under the Terms to other persons without written consent of the Administrator. The Administrator may transfer its rights and obligations without User consent, e.g., in case of business reorganization or sale of the enterprise.No Waiver of Rights
Failure to exercise or enforce by the Administrator any right or provision of the Terms does not constitute waiver of that right.Invalidity of Provisions
If any provision of the Terms proves invalid or unenforceable, it does not affect the validity of remaining provisions.Termination of Agreement
Deletion of an account by the User or Administrator results in termination of the agreement concluded under the Terms, except for provisions that are to remain in effect after termination of the agreement. Rules for deleting and restoring User Accounts are specified in §3 sections 2.5 – 2.11. After termination of the agreement, User data is processed in accordance with the Privacy Policy, particularly may be deleted or anonymized, except for data whose further processing is required by law.Survival of Provisions
Provisions concerning, among others, payments, User content, licenses, liability, dispute resolution, and final provisions remain in effect also after termination of the agreement.Section Titles
Titles and headings of individual sections of the Terms are for informational purposes only and do not affect interpretation of its content.Reporting Violations
All violations of the Terms provisions may be reported to: contact@mapenapp.com
